1. Agreement to Terms
By using the BestPick website ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the Service. Your use of the Service is also governed by our Privacy Policy.
2. The Service
BestPick provides a free, AI-powered tool that analyzes user-uploaded photos and provides a recommendation for the "best" one based on various technical and aesthetic criteria. The Service is for personal, non-commercial use.
3. User-Generated Content
A. Your Rights and Responsibilities
You are solely responsible for the photos you upload ("Content"). You represent and warrant that you own the Content or have all necessary rights to upload it and grant us the license to use it as described below.
You agree not to upload any Content that is illegal, offensive, defamatory, or infringes on any third-party rights (including copyright, trademark, and privacy rights).
B. License You Grant to Us
When you upload Content to the Service, you grant BestPick a limited, worldwide, non-exclusive, royalty-free license to use, reproduce, modify (e.g., for compression), store, and display your Content. This license is for the sole purpose of operating, developing, and providing the Service to you. This license ends when your Content is deleted from our systems, which you can initiate at any time.
4. Acceptable Use
You agree not to misuse the Service or help anyone else to do so. This includes, but is not limited to, the following:
- Probing, scanning, or testing the vulnerability of any system or network.
- Breaching or otherwise circumventing any security or authentication measures.
- Uploading viruses, malware, or any other type of malicious code.
- Using the service for any illegal purpose or in violation of any local, state, national, or international law.
5. AI Disclaimer
The AI's recommendation is a technologically generated suggestion based on data patterns. It is not a guarantee of social media success, job offers, or dating matches. The analysis is subjective and should be considered a helpful guide, not an absolute judgment. The final decision of which photo to use is always yours.
6. Termination
We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
7. Limitation of Liability
To the fullest extent permitted by law, in no event will BestPick, its affiliates, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of the Service.
8. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of material changes. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which the company is based, without regard to its conflict of law provisions.
