1. Agreement to Terms
By using the BestPick website ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the Service. Your use of the Service is also governed by our Privacy Policy.
2. The Service
BestPick provides a free, AI-powered tool that analyzes user-uploaded photos and provides a recommendation for the "best" one based on various technical and aesthetic criteria. The Service is for personal, non-commercial use.
3. User-Generated Content
A. Your Rights and Responsibilities
You are solely responsible for the photos you upload ("Content"). By uploading Content, you represent and warrant that:
- You own or have the legal right to upload the photos.
- Your Content does not violate any third-party rights, including copyright, trademark, privacy, or other personal or proprietary rights.
- Your Content does not contain illegal, offensive, or harmful material.
B. License Grant
When you upload photos to BestPick, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and process the photos solely for the purpose of providing the Service to you. We will not use your photos for any other purpose, including AI model training, without your explicit consent.
4. Acceptable Use
You agree not to use the Service to:
- Upload photos depicting illegal activity, violence, nudity, or other harmful content.
- Violate any applicable laws or regulations.
- Infringe upon the intellectual property or privacy rights of others.
- Attempt to reverse-engineer, disrupt, or interfere with the Service's operation.
- Use automated systems (bots, scrapers, etc.) to access or interact with the Service.
We reserve the right to refuse service or terminate access to users who violate these terms.
5. Disclaimers and Limitations of Liability
A. "As Is" Service
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that:
- The Service will be uninterrupted or error-free.
- The AI recommendations will be accurate, complete, or tailored to your specific needs.
- Any defects will be corrected.
B. Limitation of Liability
To the maximum extent permitted by law, BestPick and its operators will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, lost profits, or personal injury. Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us (which is zero, as the Service is free).
6. Indemnification
You agree to indemnify, defend, and hold harmless BestPick and its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any third-party rights, including copyright or privacy rights.
7. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If we make material changes, we will notify you by updating the "Last Updated" date at the top of this page. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
8. Termination
We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for any reason, including but not limited to violation of these Terms.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of Morocco, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts in Morocco.
